Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Publish Now platform and API ("Service") operated by Driven Success LLC. This policy supplements our Terms of Service and applies to all users, including developers and businesses using our API.

Violation of this policy may result in content removal, account suspension, or termination.

1. Prohibited Content

You may not use the Service to create, upload, transmit, or publish content that:

• Is illegal or promotes illegal activities in any jurisdiction
• Contains or promotes child sexual abuse material (CSAM) or the exploitation of minors
• Constitutes harassment, bullying, threats of violence, or intimidation directed at any individual or group
• Promotes hatred or discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic
• Contains non-consensual intimate imagery or deepfakes of real individuals
• Infringes on copyrights, trademarks, patents, trade secrets, or other intellectual property rights
• Contains malware, viruses, or other malicious code
• Is deliberately deceptive or constitutes fraud (e.g., phishing, impersonation, financial scams)
• Violates the privacy rights of others (e.g., sharing personal information without consent)

2. Prohibited Activities

You may not use the Service to engage in:

2.1 Spam and Automated Abuse

• Mass posting of identical or substantially similar content across accounts or platforms
• Automated follow/unfollow, like, or comment campaigns
• Creating fake accounts or fake engagement
• Posting unsolicited commercial messages or advertisements
• Circumventing platform spam filters or rate limits

2.2 Platform Policy Violations

• Any activity that violates the terms of service or developer policies of connected platforms (X, Instagram, TikTok, LinkedIn)
• Using the Service to circumvent a ban, suspension, or restriction imposed by a social media platform
• Accessing platform features or data beyond what is authorized by the platform's API

2.3 System Abuse

• Attempting to circumvent API rate limits, usage quotas, or credit restrictions
• Probing, scanning, or testing the vulnerability of the Service or its infrastructure
• Interfering with or disrupting the Service, servers, or networks connected to the Service
• Reverse-engineering, decompiling, or disassembling any part of the Service
• Using the Service to build a competing product or to benchmark against a competing product

2.4 Misrepresentation

• Impersonating any person, entity, or brand
• Misrepresenting your identity, affiliation, or the source of content
• Creating misleading accounts or profiles intended to deceive

3. AI-Generated Content

If you use the Service to publish AI-generated content, you must:

• Comply with each platform's AI content labeling requirements (e.g., TikTok's AI-Generated Content Policy)
• Not use AI-generated content to create deepfakes, impersonate real individuals, or spread disinformation
• Take responsibility for all AI-generated content published through your account

4. Multi-Tenant and Agency Use

If you use the Service to manage social media accounts on behalf of clients or third parties:

• You are responsible for ensuring all content published through your account complies with this policy
• You must have proper authorization from account owners to connect and publish to their social media accounts
• You must inform your clients that their content is being published through a third-party service

5. Reporting Violations

If you become aware of content or activity that violates this policy, please report it to yo@publishnow.app. Include as much detail as possible, including the account or content in question and the nature of the violation.

6. Enforcement

We enforce this policy through a graduated response system:

1. Warning: For first-time minor violations, we may issue a warning and request corrective action
2. Content removal: We may remove or disable content that violates this policy
3. Temporary suspension: Repeated or serious violations may result in temporary account suspension
4. Permanent termination: Severe violations, repeated offenses, or violations involving illegal activity may result in immediate and permanent account termination without refund

We reserve the right to report illegal activity to law enforcement authorities. For violations involving CSAM, we are legally required to report to the National Center for Missing and Exploited Children (NCMEC).

7. Appeals

If you believe your account was suspended or content was removed in error, you may appeal by contacting yo@publishnow.app with the subject line "AUP Appeal." We will review your appeal and respond within 10 business days.

8. Changes to This Policy

We may update this Acceptable Use Policy at any time. Material changes will be communicated through the Service or via email. Continued use of the Service after changes constitutes acceptance of the updated policy.
