DMCA Copyright Policy

Driven Success LLC ("Company", "we", "us") respects the intellectual property rights of others and expects our users to do the same. This policy describes how we handle copyright infringement claims under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

1. How Publish Now Handles Content

Publish Now is an API platform that transmits content created by users to third-party social media platforms. We do not host user-generated content long-term — content is processed and delivered to the destination platform (X, Instagram, TikTok, LinkedIn).

However, media files may be temporarily stored in our systems during the scheduling and publishing process. If you believe copyrighted material is being distributed through our Service, you may submit a DMCA takedown notice.

2. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been used through our Service without authorization, send a written notice to our designated DMCA agent containing:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it (e.g., account information, post details, API request IDs)
  4. Your contact information: name, address, telephone number, and email address
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

3. DMCA Agent

Send DMCA takedown notices to:

4. Our Response to Valid Notices

Upon receiving a valid DMCA takedown notice, we will:

  1. Promptly remove or disable access to the allegedly infringing material
  2. Notify the user who posted the content about the takedown
  3. Provide the user with information about filing a counter-notification

5. Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may submit a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material that was removed and the location where it appeared before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement that you consent to the jurisdiction of the federal district court in the District of Delaware and that you will accept service of process from the person who filed the original DMCA notice

Send counter-notifications to the same DMCA Agent address listed above.

6. Restoration of Content

If we receive a valid counter-notification, we will forward it to the original complainant and inform them that we may restore the removed content in 10 business days. If the complainant does not file a court action within 10-14 business days, we may restore the content.

7. Repeat Infringers

We maintain a policy of terminating the accounts of users who are repeat copyright infringers. If a user receives three valid DMCA takedown notices, their account may be permanently terminated.

8. Good Faith

Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages. Do not file a DMCA notice unless you are the copyright owner or authorized to act on their behalf and genuinely believe infringement has occurred.
