API Terms

These API Terms ("Developer Agreement") govern your use of the Publish Now application programming interface ("API") provided by Driven Success LLC ("Company", "we", "us"). These terms supplement and are incorporated into our Terms of Service. In the event of a conflict, these API Terms take precedence for API-related matters.
1. API Access
To access the API, you must:
- Create a Publish Now account and agree to these API Terms
- Generate an API key through your account dashboard
- Subscribe to a plan that includes API access
Your API key is a secret credential. You are responsible for keeping it secure. Do not embed API keys in client-side code, public repositories, or any location accessible to unauthorized parties. If you believe your API key has been compromised, rotate it immediately through your dashboard.
2. Rate Limits and Quotas
API usage is subject to rate limits and quotas based on your subscription plan:

| Rate limits | Maximum number of API requests per time window. Exceeding rate limits returns HTTP 429 Too Many Requests. |
| Credit quotas | Each API action (post, schedule, media upload) consumes credits from your monthly allotment. When credits reach zero, the API returns HTTP 402 Payment Required. |
Current rate limits and credit costs are documented in our API documentation. We may adjust limits with reasonable notice.
3. Permitted Uses
You may use the API to:
- Build applications that create, schedule, and publish social media content through our unified endpoint
- Integrate social media posting capabilities into your own products and services
- Manage social media accounts on behalf of your clients (agency use), provided you have their authorization
- Build internal tools for your organization's social media workflow
4. Prohibited Uses
In addition to the restrictions in our Acceptable Use Policy, you may not:
- Use the API to build a product that competes directly with Publish Now's core offering (unified social media posting API)
- Resell, sublicense, or redistribute API access without our written consent
- Cache or store data obtained through the API beyond what is necessary for your application's functionality
- Attempt to exceed rate limits through multiple accounts, distributed requests, or other circumvention methods
- Use the API for automated scraping, data mining, or surveillance purposes
- Misrepresent your application's relationship with Publish Now (e.g., implying endorsement or partnership without our consent)
5. Authentication and Security
All API requests must be authenticated using a valid API key sent via the Authorization: Bearer header. You must:
- Use HTTPS for all API requests (HTTP requests will be rejected)
- Store API keys securely using environment variables, secrets managers, or equivalent mechanisms
- Implement proper error handling for authentication failures
- Rotate API keys periodically and immediately upon suspected compromise
- Not log or display full API keys in application logs or user interfaces
6. API Versioning and Deprecation
We version the API to ensure stability for your applications:
- Current version: All endpoints are served under
/v1/ - Breaking changes: We will not introduce breaking changes to a stable API version. Breaking changes will be released under a new version number.
- Deprecation notice: When deprecating an API version or endpoint, we will provide at least 90 days' notice via email and our API documentation
- Migration period: Deprecated versions will continue to function for at least 6 months after the deprecation announcement to allow migration
7. Service Level
We target high availability for the API but do not guarantee specific uptime percentages at this time. We will provide reasonable notice for planned maintenance windows. The API is provided "as is" subject to the warranty disclaimers in our Terms of Service.
In the event of unplanned downtime, we will post updates to our status page and work to restore service as quickly as possible.
8. Data Handling Requirements
When building applications that use the Publish Now API, you must:
- Have your own privacy policy that accurately describes how you collect and process data through the API
- Obtain appropriate consent from your end users before processing their data through the API
- Not store social media access tokens obtained through the API beyond what is necessary for your application
- Promptly delete user data when requested by your end users or when required by law
- Comply with all applicable data protection laws (GDPR, CCPA/CPRA, etc.) with respect to data you process through the API
If you process personal data of EEA/UK residents through the API, you may need to enter into our Data Processing Agreement.
9. Platform-Specific Obligations
When using the API to interact with third-party social media platforms, you must comply with each platform's developer terms:
- X (Twitter): Your application must comply with the X Developer Agreement. Display requirements, content attribution, and user data handling must follow X's policies.
- Instagram / Meta: Content published via the Meta Graph API must comply with Meta Platform Terms. Only Business and Creator accounts support API publishing.
- TikTok: Applications publishing to TikTok may be subject to TikTok's developer audit process. Content visibility may be restricted until audit completion. AI-generated content must be labeled per TikTok's AI policy.
- LinkedIn: API publishing access requires participation in the LinkedIn Partner Program. You must comply with LinkedIn's API Terms of Use and branding guidelines.
10. Intellectual Property
We grant you a limited, non-exclusive, non-transferable, revocable license to use the API solely to build applications as permitted by these terms. This license does not include any right to:
- Use the Publish Now name, logo, or trademarks without our written consent
- Modify, adapt, or create derivative works of the API itself
- Access the API's source code or underlying technology
11. Suspension and Termination
We may suspend or revoke your API access if:
- You violate these API Terms, our Terms of Service, or our Acceptable Use Policy
- Your usage patterns indicate abuse, security threats, or risk to other users
- Your subscription lapses or payment fails
- Required by a third-party platform due to your violation of their policies
Where possible, we will provide notice before suspension and an opportunity to cure the violation. Immediate suspension without notice may occur for severe violations or security threats.
12. Changes to These Terms
We may update these API Terms from time to time. Material changes will be communicated via email and posted to this page at least 30 days before taking effect. Continued use of the API after changes take effect constitutes acceptance.
